Your guide for appeals and appellate practice in New Jersey
Record on Appeal

If filing an appeal in New Jersey, be mindful of the "record on appeal".  You are generally limited on appeal to the evidence and legal arguments presented to the court or administrative agency below.

As a rule of thumb, if you are appealing a judgment or order in a civil case, your record on appeal will include evidence presented below, orders entered by the court, pleadings, jury charges, transcripts of proceedings, opinions, verdict sheet, and written findings of fact and conclusions of law.  While the record on appeal includes several materials, include on appeal only those materials relevant to the issue on appeal.

If you are appealing a judgment or order in a criminal case, your record on appeal will include the materials set forth above for civil appeals.  However, instead of pleadings, you will likely have an indictment, accusation or complaint.

The "record on appeal" is more expansive than the documents included in your appendix.  In New Jersey, there is an appellate court rule that sets forth certain documents that must be included in your appendix, and which documents are prohibited.
