If you plan to file an emergent appeal (called an emergency appeal in some jurisdictions), the time to act is measured in hours, or maybe a day. Filing an emergent appeal in New Jersey requires there to be a true emergency. If you delay, you risk the appellate court denying leave to file an emergent appeal based on you creating your own emergency. Stated differently, the appellate court will be mindful of whether you, as the appellate lawyer or the litigant, created the urgency of the appeal.
